Agreement to terms
These Terms of Service ("Terms") govern your access to and use of Ember Studio (the "Service") operated by Bright Forest Software. By creating an account, signing in, or using the Service, you agree to these Terms and our Privacy Policy.

What the Service is (and is not)
Ember Studio is a stream command center: it helps you provision live destinations, manage stream metadata, unify chat and alerts, configure overlays, and plan content. The Service does not encode, host, or relay your live video.
You are responsible for encoding and transmitting your stream using your own software (such as OBS Studio with optional plugins). We are not responsible for stream quality, bitrate, or platform delivery once video leaves your encoder.
Eligibility
You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract to use the Service. You are responsible for the accuracy of information you provide and for maintaining the security of your sign-in credentials.
You must have the rights to use any content you stream, including music, images, and overlays.
Third-party platforms
The Service integrates with Twitch, YouTube, and other platforms through their APIs. Your use of those platforms remains subject to their terms of service, community guidelines, and developer policies.
We may suspend features if a platform revokes API access, changes quotas, or restricts functionality. YouTube API usage is subject to Google's quota limits; provisioning failures may occur if quotas are exceeded.
You grant us permission to act on your behalf only for the scopes you approve when connecting a platform account.
Subscriptions, trial, and billing
The Service offers a Starter (free) tier and a Creator paid tier. New accounts may receive 3 live stream runs with full Creator features at no charge ("Trial"). A trial run is consumed when you go live; cancelling before broadcast does not consume a trial run. Trial eligibility and usage are tracked per user account.
After the Trial, Starter tier limits apply unless you subscribe to Creator: $9 per month or $79 per year, plus applicable taxes. Current pricing is shown on our pricing page.
Payments are processed by Stripe. By subscribing, you authorize us and Stripe to charge your payment method on a recurring basis until you cancel.
You may cancel renewal at any time through the Stripe customer billing portal or in-app billing settings. Cancellation typically takes effect at the end of the current billing period.
If a renewal payment fails, Creator features may be suspended until payment is updated. Your account may revert to Starter tier limits.
Feature limits for each tier (such as destinations per stream run) are described on our pricing page and may be updated with reasonable notice.
Acceptable use
You agree not to:
- Use the Service for unlawful, harmful, or fraudulent activity.
- Attempt to access other users' accounts, tokens, or overlay URLs without authorization.
- Reverse engineer, scrape, or overload the Service or connected platform APIs.
- Stream content that violates platform rules or applicable law.
- Resell or sublicense the Service without our written permission.
Intellectual property
We own the Service, its software, branding, and default overlay templates. You retain ownership of your stream content, titles, and custom overlay configurations you create.
You grant us a limited license to host, process, and display your content solely to operate the Service (for example, rendering overlays in OBS browser sources or showing chat in your control room).
Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee uninterrupted streaming, platform API availability, YouTube quota availability, placement on Shorts or mobile surfaces, or specific viewer outcomes.
Vertical RTMP provisioning does not guarantee Shorts shelf placement or mobile live distribution beyond what each platform provides.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRIGHT FOREST SOFTWARE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY US DOLLARS ($50).
Indemnification
You agree to indemnify and hold harmless Bright Forest Software from claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your stream content, or your violation of these Terms or third-party platform rules.
Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service with reasonable notice where practicable.
Upon termination, your right to use the Service ends. Provisions that by nature should survive (including disclaimers, limitation of liability, and indemnification) will survive.
Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be resolved in the courts located in Delaware, unless applicable law requires otherwise.
Changes to these Terms
We may update these Terms when our practices or legal requirements change. We will post the revised Terms on this page and update the "Last updated" date. Continued use after changes constitutes acceptance of the updated Terms.
